Terms & Conditions

Guarantee:

Customer satisfaction is our main priority. Eskae jewellers are committed to producing goods of superior craftsmanship and quality. We believe that your transaction with us should be an enjoyable, and rewarding shopping experience. We guarantee that all our pieces will be delivered in new condition without damage or fault in craftsmanship.

Should any piece be damaged or there be any fault in its craftsmanship at the time of delivery to you, you may return the piece to us for a refund of the purchase price or to have the piece replaced or repaired.

When the guarantee will not apply:

Eskae jeweller reserves the right to refuse to refund the purchase price of the piece;

  1. If the returned piece is not returned in its original new and unused condition, (i.e. Scratched or marked) together with the invoice, in its original packaging
  2. If the piece is not returned within 30 days of receipt by the customer
  3. If the piece has been engraved at your request, either by us or another jeweller
  4. If you have changed your mind or if your circumstances have changed and you no longer require the piece or if you have found and/or purchased a similar piece elsewhere
  5. If the piece is damaged after the date of delivery

The guarantee does not apply to the texture applied to a piece (e.g. a satin finish texture).

Original condition:

Original new and unused condition means that there are no missing stones, that all the original stones are still in the piece, that there is no damage i.e. Scratches or marks or any wear whatsoever to any part of the piece. At Eskae jeweller we do not sell used pieces and will not accept any piece with any indication that it was used or worn. If a piece in our opinion is not returned in new and unused condition it will be returned to you and you will be charged for the full purchase price, plus any shipping, postage, handling and insurance costs incurred in delivering the piece initially and for the return of the piece to you.

Wrong finger sizes:

We will size your finger when we meet for design discussions. However:

The guarantee does not apply if you supply us with an incorrect finger size. If the size is incorrect we may resize the ring at our workshop price (plus shipping, postage, handling and insurance costs). However, you must notify us within 10 days after the date of delivery as to the need to have a ring resized/remade in a different finger size. We will then provide you with return delivery instructions.

Please note that different fingers have different sizes and your left hand fingers do not usually have the same finger sizes as your right hand.

Cancellations:

The guarantee does not apply if an order is cancelled before you receive the piece.

Eskae jeweller reserves the right not to accept cancellation of an order before delivery of the piece, and notwithstanding such cancellation to proceed with delivery. Eskae jeweller, however, may in its sole and absolute discretion accept a cancellation subject to such conditions as it sees fit.

If you cancel the order within 7 days of the date of the order a cancellation fee of 10% plus any costs incurred thus far will apply. If you cancel an order more than 7 days after the date of the order a cancellation fee of 30% plus any costs incurred thus far will apply.

Return delivery instructions:

It is imperative that if you intend to return a piece for refund, exchange or resize/remake that you contact us first by e-mail or phone so that we can confirm whether you can return the piece and whether any applicable resize or remake or cancellation fees will apply. We will then send return delivery instructions to you. For international customers the return instructions are important to minimize the costs for the return delivery fees and any applicable customs fees.

The piece must be returned to us is in its original condition together with the invoice in its original packaging within 30 days after the date of delivery.

Claiming a refund:

In order to qualify for a refund under the guarantee you must first notify us within 30 days by phone or e-mail to advise us of the problem with the piece. We will then confirm whether a refund is available for the transaction. We will then confirm whether you qualify for a refund and send return delivery instructions to you. Once we receive the returned piece we will contact you to confirm receipt. The purchase price of the returned piece will be refunded, EXCLUDING shipping, postage, handling and insurance costs. Refunds will be made in the original form of payment.

Payment Method:

Payment shall be made upon completion of the piece and before the piece is delivered to you. No piece will be handed over until full payment has been received. Risk in any goods supplied by Eskae jeweller shall pass to the customer when goods are despatched or delivered to the customer, however, ownership and property in each piece supplied is retained by Eskae jeweller until payment in full of the purchase price.

We are able to accept payment for orders by Visa, MasterCard, EFTPOS, bank cheque, money order and direct deposit payments. For overseas orders we are unfortunately not able to accept payment by international money order or international bank cheque.

Shipping Policy:

All goods are insured against loss and damage whilst they are in transit. Once you are advised by e-mail that your order has been dispatched, we guarantee delivery except in cases where the address supplied is incorrect, illegible, incomplete or if you are away or have moved, in which case you will be liable for payment of the purchase price and shipping, postage, handling and insurance of the order irrespective of whether the order arrives on time or not at all.

We will not deliver orders to a post office box as all orders must be signed for. If you have any questions about the appropriate delivery address please contact us to discuss appropriate arrangements.

Complete information and suspicious orders:

Eskae jeweller reserves the right to refuse any order if it believes that it is fraudulent or is suspicious in nature. No order will be accepted unless full contact information is provided including full addresses, e-mail address and phone numbers. You must include your e-mail address with your order otherwise we will not be able to contact you.

Legal Jurisdiction:

All orders placed with Eskae jeweller and all incidental agreements and matters are governed by the laws of the State of New South Wales, Australia. Eskae jeweller reserve the right to correct, update, modify or otherwise change the terms and conditions of sale, information, and prices at any time at its website at its sole discretion without notice. Eskae jeweller, its affiliates or employees shall not be liable for any indirect, incidental; punitive or consequential damages arising directly or indirectly from the use of any of the information contain in or received from its website.

Appraisals, Grading Reports and Lab Certificates:

These are in part, subjective, and may vary as to quality and description depending upon the agent, laboratory, appraiser and the scientific methods applied. The customer acknowledges that his use of the website and its resources, information and services shall be solely at his own risk.

Eskae jeweller, its products, images, logos and all pieces displayed on its website are protected by Australian and international copyright and trademark laws. It is expressly prohibited to reproduce, use, modify or in any way display or distribute this information without our permission. The customer further agrees that these conditions cannot be modified by any oral statements or representations or any other dealings between Eskae jeweller and its customers.
